Important: These Terms of Service (“Terms”) are a legal agreement between you and Risaro GROUP (trading as OURYE). They are not legal advice. We recommend that a qualified lawyer review them for your situation before you rely on them for compliance.

In plain language: These rules explain how you may use ourye.com, how buying works, and what each of us can expect. If you use the site or order from us, you agree to these Terms (except where the law gives you rights that cannot be waived).

1. Who we are

OURYE is operated by Risaro GROUP (“we”, “us”, “our”), a business with its contact address at 7175 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom.

2. Agreement to these Terms

By accessing our website, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Cookie Policy (where they apply). If you do not agree, you must not use our website or purchase from us.

Specific policies that form part of your purchase contract include our Shipping Policy and Refund & Returns Policy (including statutory withdrawal information for eligible consumers).

3. Our service

We operate an online retail store offering fashion and related products. We sell to consumers in the countries and on the conditions described in our Shipping Policy. Fulfilment is carried out through our European distribution network and logistics partners. We may change our catalogue, prices, promotions, and website features at any time without prior notice, except where we have already accepted your order.

In plain language: We sell products online and ship via our logistics network. The shop can change, but once we confirm your order, that order is governed by the terms that applied when you checked out.

4. Eligibility

You must be at least 18 years old (or the age of majority in your country) to place an order. By ordering, you confirm that you meet this requirement, that your payment information is authorised, and that the delivery address is valid and within our shipping zone.

5. Product information, pricing, and availability

In plain language: We aim for accurate photos and prices. If something is wrong, we’ll fix it or cancel — we won’t trick you.

  • Prices are shown in EUR (€) by default and may be converted or displayed in other currencies depending on your market settings. VAT or applicable sales tax is included in the price where we are required to show tax-inclusive pricing; any separate tax line or import charges are explained at checkout where our platform displays them.
  • Product images, descriptions, sizes, colours, and materials are provided in good faith. Minor variations (e.g. screen colour) do not make a product “not as described” if the item matches the essential characteristics listed.
  • We may correct pricing errors, typographical errors, or stock errors before or after you place an order. If we cannot fulfil your order at the stated price or due to unavailability, we will notify you and may cancel the order; you will not be charged, or any payment will be refunded.

This supports transparent, non-misleading shopping experiences consistent with marketplace and advertising policies (including accurate pricing at checkout and on product pages).

6. Orders, contract formation, and payment

In plain language: Checkout is your offer to buy. We accept by confirming the order by email.

When you complete checkout, you make an offer to purchase. A binding contract is formed when we send you an order confirmation email (or when we dispatch the goods, if our process states otherwise in that email). We may refuse or cancel an order for reasons including fraud prevention, stock limits, errors, or legal restrictions.

Payment is processed securely by our payment provider(s) (e.g. Shopify Payments, PayPal, or other methods shown at checkout). We do not store your full payment card number. You authorise us and our providers to charge your selected method for the total shown at checkout (goods, applicable taxes, and shipping).

Chargebacks and fraud: False or abusive payment disputes may result in account closure and recovery of costs where permitted by law.

7. Shipping and delivery

Shipping costs, estimated timeframes, customs information for certain countries, and risk of loss are governed by our Shipping Policy, which is incorporated into these Terms by reference.

8. Returns, refunds, and statutory withdrawal

Cancellations, returns, refunds, the EU/UK 14-day right of withdrawal, and the model withdrawal form are set out in our Refund & Returns Policy, which is incorporated into these Terms. Nothing in these Terms limits mandatory consumer rights under the laws of your country of residence.

9. Consumer rights and business purchasers

If you are a consumer (an individual buying mainly for personal, non-business use), statutory consumer protections apply, including from the country where you live, where mandatory.

If you purchase for business purposes, some consumer rights may not apply; the governing law and jurisdiction provisions below may affect you differently. Contact us if you are unsure.

In plain language: Private shoppers get stronger legal protections than companies buying for business.

10. User accounts

If you create an account, you must provide accurate information and keep your password secure. You are responsible for activity under your account until you notify us of unauthorised use. We may suspend or close accounts that breach these Terms or pose a security risk.

11. Acceptable use

You agree not to:

  • Use the website for any unlawful purpose or in violation of export or sanctions rules;
  • Attempt to hack, scrape, overload, or interfere with the site or other users;
  • Use bots or automated means to purchase for resale or to circumvent limits without permission;
  • Submit false identities, payment details, or orders;
  • Misrepresent products or our brand in resale or advertising without authorisation.

12. Reviews and user content

If you submit reviews, photos, questions, or other content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt that content on our website and marketing channels in connection with OURYE. You confirm you have the rights to submit the content and that it is truthful and not defamatory or illegal. We may remove content that breaches these Terms or applicable law.

In plain language: If you post a review, we may show it on the site. Don’t post anything you don’t own or that’s false or abusive.

13. Intellectual property

All website content (text, graphics, logos, photographs, layout, software) is owned by Risaro GROUP or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or exploit our content without prior written consent except for personal, non-commercial browsing or as required to use the checkout.

In plain language: The OURYE brand and site content belong to us — don’t copy for commercial use.

14. Limitation of liability

In plain language: We limit our liability where the law allows, but we never limit things the law says we can’t limit (like death, fraud, or your core consumer rights).

To the fullest extent permitted by applicable law (including mandatory EU/UK consumer law):

  • We are not liable for indirect or consequential loss (e.g. lost profits, lost data) arising from use of the website or products.
  • Our total liability for any claim relating to a specific order is generally limited to the amount you paid for the products in that order, except where a higher minimum applies under statute.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

15. Disclaimers

Except as required by law, the website and products are provided on an “as is” basis. We do not warrant uninterrupted or error-free operation of the site. Product warranties implied by law (e.g. conformity with contract under EU/UK consumer sales rules) are not excluded where they apply to consumers.

In plain language: We don’t promise the site never glitches, but statutory rights on faulty goods still apply to consumers.

16. Indemnification

You agree to indemnify and hold harmless Risaro GROUP and its officers and agents against claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms or misuse of the website, except to the extent such indemnity is prohibited for consumers under mandatory law.

In plain language: If you break the rules and we get sued because of it, you may have to cover our reasonable losses — where the law allows.

17. Force majeure

We are not liable for delay or failure to perform caused by events outside our reasonable control, including natural disasters, war, terrorism, labour disputes, failures of carriers or suppliers, or actions of authorities.

In plain language: If something major outside our control stops us, we’re not on the hook for that delay.

18. Suspension and termination

We may suspend or terminate access to the website or close your account if you materially breach these Terms, create risk or legal exposure, or for operational reasons with notice where practicable. Provisions that naturally continue (e.g. IP, liability limits where valid, disputes) survive termination.

In plain language: Serious misuse can get you blocked from the site.

19. Governing law and dispute resolution

In plain language: We choose English law for the contract framework, but EU/UK consumers keep the protections of their home country where the law requires.

  • These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules that would apply another law, subject to mandatory consumer protections of the country where you reside if you are a consumer.
  • Subject to mandatory rights, the courts of England and Wales have non-exclusive jurisdiction. Consumers may also bring proceedings in their country of residence where EU/UK rules allow.
  • We encourage you to contact us first at Contact@ourye.com to resolve disputes amicably.
  • EU Online Dispute Resolution: The European Commission provides an ODR platform: https://ec.europa.eu/consumers/odr. We are not obliged to use a specific alternative dispute resolution body but will consider good-faith approaches.

20. Severability and entire agreement

If any part of these Terms is held invalid, the remainder stays in effect. These Terms, together with the policies linked above, constitute the entire agreement between you and us regarding the website and purchases, replacing prior understandings on the same subject unless required otherwise by law.

In plain language: If one clause fails, the rest still counts. These Terms plus the linked policies are the main deal.

21. Changes to these Terms

We may update these Terms. The “Last updated” date will change. For material changes, we will provide notice where required (e.g. email or prominent website notice). Continued use after changes may constitute acceptance where permitted by law; existing orders remain governed by the Terms in effect at the time of purchase unless we notify you otherwise.
